Councils operate under a wide array of legislation. These Acts both empower councils and set out some expectations of councils.

The Department of Internal Affairs administers three of the key Acts under which councils operate. These are -

Better Local Government

On March 19 2012, the Government announced an eight point reform programme for local government. The reforms are aimed at providing better clarity around the role of councils, stronger governance, improved efficiency and more responsible financial management. They are part of the government’s broader programme for building a more productive, competitive economy and better public services.

  • The Freedom Camping Act

      The Freedom Camping Act received Royal assent on 29 August 2011 and is administered jointly by the Department of Conservation and the Department of Internal Affairs.

      Local Government Review

      The cabinet papers and minutes on the Government's decisions relating to a review of the local government system, entitled "Smarter Government, Stronger Communities: Towards Better Local Governance and Public Service", have been posted on the Department of Internal Affairs website.

      Local Government Act 2002 Reform

      The Transparency, Accountability and Financial Management of Local Government (TAFM) Reforms to the Local Government Act 2002 are being implemented.

      Nelson-Tasman reorganisation scheme approved by Local Government Commission

      A new local government structure for the Nelson and Tasman area, to be called the Nelson Tasman District, has been approved by the Local Government Commission and will be put to the electors of both districts for approval in separate polls. If approved, the new scheme will come into effect on 1 November 2012.
